If you're like most employers, you've probably been stunned by the recent multi-million dollar employee lawsuits hitting businesses. Many of the biggest cases involve claims by supposedly "exempt" employees suing for unpaid overtime (e.g., the $90 million verdict against Farmers Insurance Exchange).

The primary reason these companies violated the law was that they were blindsided by California's complex wage and hour regulations. And, trying to figure out how to comply with the law is especially a problem for companies with employees both in California and other states. Unfortunately, you can't have a uniform standard for who qualifies as "exempt." Even if employees are "exempt" under the federal overtime law in other states, you've got to comply with the California Wage Orders as well.
